These Terms of Service (“Terms”) govern your use of EDMProd websites, stores, courses, digital products, downloads, communities and related services.
The Services are provided by EDMPROD LIMITED, a New Zealand limited company (“EDMProd”, “we”, “us” or “our”).
These Terms apply to our websites and services, including edmprod.com, store.edmprod.com, our student/course platform, and other EDMProd services that link to these Terms.
By accessing our Services, creating an account, or purchasing a product, you agree to these Terms. If you do not agree, you should not use the Services.
Nothing in these Terms limits any rights you have under the New Zealand Consumer Guarantees Act 1993, Fair Trading Act 1986, Privacy Act 2020, or any other consumer protection law that cannot legally be excluded or limited.
1. Eligibility and accounts
You must have legal capacity to enter into an agreement with us.
If you are under 18, or under the age at which you may enter into a binding agreement in your jurisdiction, a parent or legal guardian must agree to these Terms and make or authorise any purchase on your behalf.
You are responsible for keeping your account credentials secure and for activity conducted through your account.
Accounts and course access are personal to the purchaser unless we expressly agree otherwise. You may not sell, transfer, share or provide your account credentials to another person.
Please contact us promptly if you believe your account has been accessed without permission.
2. Our products and services
EDMProd provides educational courses and digital music-production products. These may include video courses, PDFs, guides, presets, Ableton Live racks, samples, MIDI files, project files, templates, downloadable resources, community access, coaching or other digital materials.
The specific contents, features, compatibility requirements and access terms for a product are described on its sales or product page at the time of purchase.
We may improve, update or reorganise our products over time. This can include updating lessons, replacing outdated material, changing instructors, improving downloads or moving content between technology platforms.
3. Digital access and “lifetime access”
Where a product is advertised as including “lifetime access”, “access for life” or similar wording, our intention is to provide ongoing access to that product without requiring you to repurchase it.
Because online technology, hosting providers, software and business circumstances change over time, we cannot guarantee that a particular website, platform or delivery method will exist indefinitely.
If we permanently discontinue hosting a lifetime-access product, we will, where reasonably practicable, provide affected customers with reasonable notice and an alternative means of accessing or retaining the core materials they purchased.
This does not require us to maintain outdated software compatibility, third-party services, live events, community features or support services indefinitely unless expressly stated at the time of purchase.
4. Product compatibility
Some EDMProd products require particular third-party software, plugins, digital audio workstations, operating systems or software versions.
You are responsible for checking the stated compatibility requirements before purchasing.
We are not responsible for changes made by third-party software developers after your purchase, although we may provide updates or compatibility improvements at our discretion.
Nothing in this section limits your rights where a product was materially misdescribed or was not fit for a purpose that we represented it as suitable for.
5. Prices, currency and taxes
Unless otherwise stated, prices on EDMProd are displayed in US dollars.
Prices, promotions and discounts may change from time to time. The price applicable to your purchase is the price displayed when your order is submitted.
Taxes may be added or collected where required by law.
We may correct genuine pricing or technical errors. If an error materially affects an order you have already placed, we will contact you and, where appropriate, offer you the choice of proceeding at the correct price or receiving a refund.
6. Orders and payment
Submitting an order constitutes an offer to purchase the selected product.
Your order is accepted when payment is successfully processed and we confirm or provide access to the product.
Payments may be processed by third-party payment providers. We do not generally receive or store your complete payment-card details.
You agree to provide accurate billing and account information and confirm that you are authorised to use the payment method supplied.
7. Instalment and payment plans
A payment plan is generally a purchase of a product for a fixed total price paid in instalments. It is not a monthly subscription unless the offer expressly says otherwise.
By selecting an instalment plan, you authorise us or our payment provider to charge the stated instalments according to the payment schedule presented when you purchase.
Unless you obtain a refund under our Refund Policy or have another legal right to cancel, selecting instalments does not convert the purchase into a month-to-month service that can be cancelled simply by stopping payments.
If an instalment fails, we may retry the payment and may temporarily suspend access until the account is brought up to date.
If a qualifying purchase is refunded during its money-back guarantee period, we will cancel remaining EDMProd instalments associated with that purchase and process the applicable refund.
8. Subscriptions
If EDMProd offers a recurring subscription, membership or other automatically renewing service, the recurring price and billing frequency will be disclosed before purchase.
You authorise recurring charges until you cancel the subscription.
Unless otherwise stated, cancellation stops future renewals and you will continue to have access until the end of your current paid billing period.
Cancellation does not affect statutory rights or any refund right expressly provided with the subscription.
9. Refunds
Purchases are covered by our Refund & Cancellation Policy, which forms part of these Terms.
Many EDMProd products include a voluntary 30-day or 60-day money-back guarantee. The specific guarantee displayed on the product or sales page at the time you purchase applies to that purchase.
These voluntary guarantees are additional to, and do not replace or restrict, any rights you may have under applicable consumer law.
10. Licence for courses and educational content
Unless we expressly state otherwise, EDMProd courses, videos, PDFs, guides, worksheets, project files and educational materials are provided to you under a limited, personal, non-transferable licence.
You may use them for your own learning and music-production activities.
You may not reproduce, upload, distribute, sell, sublicense, share or commercially republish the educational materials themselves.
You may not purchase a course and provide account access or copies of the materials to other people.
11. Licence for presets, samples, racks and production resources
Where a product contains presets, samples, Ableton racks, MIDI, templates or other music-production resources intended for use in your own music, you may use those resources in your own original musical works, including commercially released music, unless the applicable product states otherwise.
Where a product is described as “royalty free”, you do not owe EDMProd royalties for properly using those resources in your own musical works.
You may modify the resources for your own productions.
You may not sell, sublicense, share, upload or redistribute the original resources, or substantially equivalent versions of them, as standalone files, sample packs, preset packs, racks, templates, libraries or competing products.
You may not make the source files available in a manner that allows another person to extract or reuse them independently of your finished musical work.
Any third-party content included with a product remains subject to any licence terms identified with that content.
12. Artificial intelligence and automated extraction
You may not systematically scrape, copy or extract EDMProd courses, written content, videos, downloads or proprietary datasets for the purpose of training, fine-tuning, grounding or creating a commercial artificial-intelligence system or competing educational product without our prior written permission.
Ordinary use of AI tools as part of your personal music-production or learning workflow is not prohibited by this section.
13. Intellectual property
EDMProd and its licensors retain all intellectual property rights in the Services and EDMProd materials except for rights expressly licensed to you under these Terms.
The EDMProd name, logos, product names, website design, educational materials, videos, graphics and other original content may be protected by copyright, trademark and other intellectual-property laws.
Purchasing a product gives you a licence to use it as described in these Terms. It does not transfer ownership of our intellectual property to you.
14. Your music and creative work
We do not acquire ownership of music or other original creative work you make merely because you use EDMProd products or educational materials in creating it.
Where you lawfully use royalty-free EDMProd production resources within your own original musical work, you remain free to release, distribute, perform, monetise and commercially exploit that musical work.
15. Community and user content
If we provide community, commenting, feedback or upload features, you remain responsible for content you submit.
You must not upload content that is unlawful, infringes another person’s rights, contains malicious software, harasses others or materially interferes with the operation of the Services.
You grant us a non-exclusive licence to host, display and process content you voluntarily submit to the extent reasonably necessary to operate the relevant feature.
If you voluntarily provide a testimonial, review or feedback that you agree may be used for marketing, we may reproduce it in connection with promoting EDMProd, subject to applicable law.
16. Prohibited conduct
You must not use the Services unlawfully, attempt to gain unauthorised access to our systems, circumvent access controls, distribute malware, interfere with other users, scrape our Services at scale without permission, impersonate another person, infringe intellectual-property rights, or use the Services to facilitate fraud or abuse.
We may investigate suspected misuse and take reasonable measures to protect EDMProd, our customers and our systems.
17. Suspension and termination
We may suspend or terminate access where we reasonably believe you have materially breached these Terms, committed fraud, shared or redistributed our products without permission, interfered with our systems, or failed to pay amounts properly due.
Where appropriate, we will attempt to provide notice and an opportunity to remedy the issue.
Nothing in this section permits us to avoid obligations we owe you under applicable consumer law.
18. Educational nature of our products
EDMProd provides education, tools and resources designed to help users improve their music-production skills.
Results vary between individuals. We do not guarantee that purchasing a course or product will result in professional success, commercial releases, record-label placements, income, audience growth or any particular creative outcome unless an express written guarantee states otherwise.
19. Third-party services
The Services may use or link to third-party platforms such as payment processors, video platforms, course-hosting services, ecommerce providers and software companies.
Those third parties may have their own terms and privacy policies.
We are not responsible for third-party products or services outside our reasonable control, but this does not limit rights you may have against EDMProd where the third-party service forms part of something we are legally responsible for supplying to you.
20. Service availability
We aim to keep our Services reliably available but cannot guarantee uninterrupted access.
Maintenance, cybersecurity incidents, internet failures, third-party platform outages and other events outside our reasonable control may occasionally interrupt access.
We will take reasonable steps to restore material paid services where practicable.
21. Consumer rights and warranties
Nothing in these Terms excludes, restricts or modifies any guarantee, warranty, condition, right or remedy that cannot legally be excluded.
For New Zealand consumers, this includes rights that may arise under the Consumer Guarantees Act 1993 and Fair Trading Act 1986.
Consumers in other countries may also have mandatory local rights that continue to apply regardless of the governing-law provision below.
22. Limitation of liability
To the maximum extent permitted by law, EDMProd will not be liable for indirect, incidental, special or consequential loss arising from use of the Services, including lost profits or lost business opportunities, where that loss was not reasonably foreseeable or where liability may lawfully be excluded.
Where liability may lawfully be limited, our aggregate liability arising from a particular paid product or transaction will not exceed the amount you paid EDMProd for that product or transaction.
These limitations do not apply where liability cannot legally be excluded or limited, including any applicable statutory consumer rights.
23. Privacy
Our collection and use of personal information is governed by our Privacy Policy.
We may send transactional communications necessary to operate your account, fulfil purchases, provide access, address security issues or administer services.
Marketing communications are handled separately and may be unsubscribed from using the unsubscribe mechanism provided with those communications.
24. Changes to these Terms
We may update these Terms to reflect changes to our Services, technology, business practices or applicable law.
The current version will be published with its effective date.
If a change materially affects an ongoing paid service or materially reduces existing contractual rights, we will take reasonable steps to notify affected customers where required or appropriate.
Changes will not retrospectively remove rights you already acquired under a completed purchase.
25. General
If any provision of these Terms is found unenforceable, the remaining provisions continue in effect.
Our failure to enforce a provision on one occasion does not waive our right to enforce it later.
These Terms, together with any applicable product-specific terms, Refund Policy and Privacy Policy, form the agreement between you and EDMProd regarding the Services.
If a product-specific offer expressly gives you a more favourable right than these Terms, the more favourable product-specific term applies to that purchase.
